法律规范的权威定义及结构理论之质疑

The Criticism on the Definition of Legal Norm and Its Logical Structure

现有法律规范的权威定义受制于反映论的认识进路,不仅未能全面揭示法律规范的内在含义,而且在属概念不明之时,自身也晦暗不清。法律规范的概念可以界定为法律文本中表述某主体在一定条件下对其他主体就某客体当为某类行为的条文所表示的意义。以此定义观之,在现有法律规范权威定义框架下建构的法律规范结构理论,论述的其实是复数法律规范间的复合结构,而不是法律规范的结构。
