摘要
目前我国罚金刑适用的范围在不断扩大,但罚金刑数额立法存在很多弊端,应当采用以犯罪人的年总收入作为基数的罚金制,即"新型倍比罚金制",来完善我国罚金刑数额的立法。
In our country the apply of fine continually expanding the scope at present,but the Chinese legislation of volume of fine has some malpractices,we should adopt the new type of times-ratio fine to perfect legislation of volume of fine of Chinese,which is a new fine system that take the criminal s total income of one year as the base of the volume of fine except circumstances of the crime.
