摘要
行政听证制度是现代行政程序的核心制度。行政处罚听证制度在保障行政相对人合法权益,保证行政处罚决定的合法性和合理性等方面发挥着重要的作用。实践中,行政处罚听证适用范围过窄、听证笔录法律效力低等问题使行政处罚听证制度的作用没有得到充分发挥,因此亟待完善行政处罚听证制度。
The administrative hearing system is the core of modern administrative procedure. It is very important for legal right protection of people concerned and protection of legitimacy and rationality of administration penalty. There are many questions in the public hearing of law countermeasure in practice. For example, too narrow applicable range and low Legal Effect of hearing record. So, it must be perfected immediately.
