业主委员会之法律地位新视角探析

An New Insight into the Legal Status of the Owner Committee

业主委员会自产生以来就存在着性质模糊、法律地位不明确、权责不清等问题,学界关于这些问题的讨论从未停止过,但也没有达成一致意见。《物权法》中关于业主委员会的规定较为原则,新修订的《物业管理条例》依然没有明确业主委员会的法律地位。由此,我们必须在《物权法》以及修订后的《物业管理条例》的新视角下重新审视业主委员会之法律地位问题。本文认为业主委员会在实体法上是属于"其他组织"的第三类民事主体,在程序法上具有民事诉讼主体资格。
