Finding the Balance between Liberty and Order——The Rights to Beg in the United States and China's Mainland

作为贫困现象衍生物的乞讨不仅难以有效消除,而且越来越成为各国政府、尤其是城市政府实现有效治理的一大难题。为了实现自由与秩序之间的平衡,中美两国政府都设计并实施了多种规制方案解决乞讨及其所带来的问题。两国的规制模式之间存在着值得关注的相似和差异,既求同存异又殊途同归。本文的结论认为,为了达到更优质的平衡,政府应当努力消除迫使人们乞讨的贫困现象,而不能单纯依赖于乞讨规制措施。
