死缓适用的实质条件,指的是"不是必须立即执行"。虽然我国刑法对死缓适用的实质条件作了规定,但规定得不具体。为了实现慎杀和少杀的政策,最高人民法院应尽快通过司法解释对"不是必须立即执行"的含义加以具体化,以发挥死缓制度在死刑控制中的应有作用。
