摘要
昂贵的药物使发展中国家的病人无法获得必需的药品,发展中国家从而面临严重的公共健康危机。人权主义者为此指责药品专利保护制度,认为获得药品的治疗是基本人权,但药品制造商却认为专利制度是促进新药研发的必要激励制度。世界贸易组织的《与贸易有关的知识产权协定》试图在两者中取得平衡。本论文就TRIPs如何在专利和公共健康中保持平衡进行分析,结合其最新的发展,指出其存在的不足,并提出相关的建议。
