法律以确定性作为自身追求的目标和表现形式。法律的确定性首先是其价值的确定性 ,其次是法律的形式理性。在不同的历史时期 ,公、私法在价值、形式理性上的确定性是不同的。自近代以来 ,公、私法在确定性上实现了一致。

Law takes the certainty as its pursuing objective and expression form.Its certainty is,firstly,its value certainty,and,secondly,its formal reason.In varied period,public law and private law are different in the certainty of the value and formal reason.Since the mordern time,they have realized the unity at their certainty.
