民族区域自治地方立法变通权的法理基础

自治权所包含的内容最重要的当数立法权。在"自治"前提下的立法权就必然内涵着立法的变通权,从来源上讲,立法变通权源于自治权。没有自治权,立法变通将成为无源之水、无本之木,缺乏产生的根据和基础。反过来讲,如果仅有自治权未赋予立法变通权,自治权必将是残缺或虚幻的。只有允许民族自治地方合法、合理地变通法律、行政法规中不适合民族自治地方特点和实际情况的条款,消除国家法律在民族地区实现的障碍和瓶颈,才能将立法变通权真正落到实处,实现实体正义,惠泽少数民族自治地方。
