摘要
劳动合同试用期,是用人单位对试用劳动者进行职务适格性判断的一个实验期。试用期所具有的"实验性"目的使其区别于见习期和学徒期。从法律性质上看,我国的劳动合同试用期规定类似日本的"解雇权保留说"。我国应当适度降低劳动合同试用期的解雇保护强度,还原试用期的本来面目。
Probation period is a period that is used by employers to test employees' aptitude for a job.The test objective of probation period makes it different from novitiate and apprentice period.From a viewpoint of legal nature,probation period in our nation was similar to Japanese theory 'reservation of dismissal right'.We should reduce moderately the dismissal protection intensity to restore the original state of probation period.
