农村土地承包经营权制度的现状与问题

The Status and Problems of Rural System for Contract Land Management Right

农村土地承包经营权制度是中国特色的土地制度,该制度在中国农村实施近30年来,由于各地的自然、经济和社会条件以及历史文化背景千差万别,导致其存在不同的表现形式,同时其缺陷也日益突显出来。基于此,对农村土地承包经营权制度的现状、存在的缺陷及其含义进行了论述,并认为,物权化的农村土地承包权是我国农村土地承包经营权模式的最佳选择。

The system of rural contract land management right is the Chinese specific land system,and it was implemented in China about 30 years.The way of expression was different and the defects are appeared increasingly due to the differences of natural,economic,and social conditions and cultural background.This paper reviewed the situation,defects and the meanings of rural system for contract land management.The paper proposed that the property righted contract land management right is the best choice of the rural system for contract land management right.
