对法人财产权的定性问题,长期以来在中国法学界争论不休。基于对法人的财产权以及所有权、经营权等物权的比较分析,法人财产权就是经营权;而投资者对法人财产拥有股权,即让渡了部分权能的所有权。由于股份有限公司是典型的现代企业制度,故这里所讨论的法人财产权仅限于股份有限公司。

How to determine the nature of corporation's property right is a long-debating issue. Through the comparative analysis of legal person's property right, operation right and ownership, it is discovered that corporation property right is just the operation right and the investor has the share-holding equity. Corporation's property right is limited just in joint-stock company because of its typical and modern business system.
