试析精神损害赔偿的几个法律问题

On Problems about Compensation for Spiritual Damage

我国在《民法通则》和相关司法解释中虽然对精神损害赔偿在一定范围内进行了规定,但是精神损害赔偿一直是法学界关注的热点和难点问题,精神损害赔偿由于没有既定的统一标准且又与公民的切身权益密切相关。客观地说,精神损害赔偿是市场商品经济发展到一定阶段的必然的产物。尽管我国目前的精神损害赔偿制度与以前相比已有较大进步,但仍有许多不足,本文结合我国相关法律和司法解释的规定,对精神损害赔偿的几个问题进行探讨。

In the General Rules of the Civil Law and relevant judicial interpretation,the term of spiritual damage is stipulated limitedly and it has been the focus of concern and thorny problem in law society.However,there is no set standard for the compensation for spiritual damage,which is closely related to citizens' interests.Objectively speaking,the compensation for spiritual damage is the result of developing market economy at a certain stage.Although greater progress has been made in the compensation for spiritual damage at present than before,some deficiencies are still in existence.Concerning the relevant laws and judicial interpretation of it,the writer is making an exploration into several problems about the compensation for spiritual damage.
