进化、移植与传播——从前南诏时期的云南看法的形成与发展

Evolution,Transplantation,and Dissemination:The Birth and Development of Law as Seen in Yunnan Before the Nanzhao Kingdom

关于法的产生及概念,至今仍是一个颇有争议的范畴。为了避免法律概念的陷井,本文用规则这一概念来探讨法的形成和发展。从前南诏时期之云南地区来看,规则是广泛存在的,它构成了当地制度和文化的主要方面和重要组成部分,是当时社会控制的主要手段之一。从考古学资料、文献材料和民族学理论等史料看,前南诏时期云南地区的规则主要由进化、传播与移植三个维度形成和发展起来,形成了云南早期特色鲜明的规则体系。

The birth of law and even the concept of law itself are still controversial.To avoid conceptual pitfalls,this paper uses rules instead in discussing the birth and development of law.Widely present in Yunnan before the Nanzhao Kingdom,rules were an important component of the local constitution and culture,functioning as a major means of social control.Research findings in archeology and literature,supported by ethnological theories,show rules in pre-Nanzhao Yunnan came into being by evolution,transplantation,and dissemination.
