The Approximal Principle in Civil Rights and Duty

民事权利义务最近原则就是以一个权利人或义务人为核心,逐层由近及远展开来确定相关义务人或权利人,以承担义务或享受权利。该原则的确立可以解决现行民事法律无法包括的也没有必要罗列的民事问题,可以使大量无法可依的民事案件找到一个合理的解决办法,弥补法律条款之不足。

The approximal principle in civil rights and duty is to establish differential rights and duty of involved persons according to their distance from the obligee at the center. This principle will cover cases not fully included or not necessarily listed in present civil laws, so that many cases will be reasonably settled.
