摘要
劳动教养是我国特有的一项法律制度,其利弊共存。当前,在维护社会稳定与依法治国、保障人权的宏观背景下,如何改革完善现行的劳动教养制度,充分发挥其积极作用,越来越为社会各界所关注。文章从劳动教养制度为什么要改革,怎么改和改什么等方面进行了一些探索,以冀抛砖引玉。
The Education-through-labor is an unique legal system in China,and it’s advantages and disadvantages co-exist.Presently,it draws more and more attention from the community on how to reform the present education-through-labor system and make it play its positive role fully under the macroscopic background of maintaining social stability,rule of law,and human rights.This article starts from why the education-through-labor system needs to reform,how to reform,and what should be to change,and it aims to offer a few introductory remarks so that others may offer their valuable ideas.
