A Law Puzzle on Ownership and an Economic Answer

在我国的传统所有权制度研究中,所有权的概念、所有权制度的起源、所有权制度的可交易性等方面的研究存在漏洞与问题。运用法律经济学的观点和方法,针对这些问题,给出合理的经济学解释,能够推进所有权制度的创新与完善。

Based on the reflection of the study on the traditional ownership system in China , this paper puts forward some questions and loopholes on the concept, origin and the transaction of ownership. What's more, it also gives some reasonable economic explanations on these issues by means of applying views and methods related to law and economics in order to promote the development of ownership system.
