Some Comments on Hans Kelsen's Pure Law Theory

凯尔森在法律思想史上的伟大功绩是以"片面的深刻"廓清了法学研究的三大论域规范、价值、事实。凯尔森坚持科学的法律学只能叙述对象不能评价对象,没有认识到人文——社会科学与自然科学认知对象的区别:前者的认知对象本身就已经承载了价值和意识,因此凯尔森只对法规范进行逻辑的结构的分析不能保证纯粹法学的科学性;凯尔森没有看到,对社会科学而言,价值并非一种主观任意,而是检验理论是否为科学的标准之一;笔者指出:法律问题不仅是一个技术问题,同时也是一个道德问题。

In the history of law thoughts,Hans Kelsen made a significant contribution by outlining the three fields of law research which are standard,value and fact with his one-sided profundity.By persisting in that law could only describe its targets but not judge them,Kelsen failed to recognize the differences between cognitive objects of humanities and social sciences and natural sciences.The objects of humanities and social sciences bear value and consciousness with themselves.Only by logical and structural analysis of law standards,Kelsen can not guarantee that the pure law is scientific.He did not recognize that,in a perspective of social sciences,value is not a subjective will,but a criterion to test whether a theory is scientific.It is proposed that the issue of law is not only related to technique but to ethic.
