对物权法中农民土地权益问题的思考

Reflection on Land Right of Peasantry in Property Law

土地是农民安身立命的根本,《物权法》加大了对农民土地权益的保护,但基本上仍维持了现有政策,土地承包经营权与宅基地使用权的流转仍嫌不足,在土地征用中,公共利益之目的条款需要进一步解释,而相关的征用程序也需要完善。

Land is fundamental for peasantry,Property Law increases the protection of land right of peasantry,but it basically remains policies in existence.Contracted management rights of land and rights to the use of house site still have problems.During expropriation of land,items about public behalf need to be further explained and relative procedure should be improved.
