摘要
契约自由是契约的灵魂。它有两方面含义:一是强调契约是当事人双方的合意;二是强调契约的产生是当事人自由选择的结果。两大法系契约理论的趋同表明,契约并没有死亡,只是契约法发生了变迁。
As the soul of contract,contract freedom has two meanings.One means emphasis of the both acceptability for contract and the other means that contract is the free choice for both.The two law systems of contract theory indicate that contract law only shows flux instead of die.
