刍议中国同性恋的立法

On the Legislation of Homosexuality in China

随着社会的发展和科技的进步,人们价值观念日趋多元化,同性恋权利运动和人权运动的不断发展,对传统的婚姻制度提出了前所未有的挑战,同性恋及同性婚姻问题作为婚姻家庭法领域的一个新课题,得到人们越来越多的关注。在世界部分国家已经把同性恋乃至同性婚姻都合法化的今天,中国也有必要对此进行立法。本文从人类对同性恋认识的发展过程出发,结合我国的实际,对我国同性恋立法的必要性进行探讨,提出一些立法上的建议,以期引起对同性恋的法学关注。

With the development of the society and technology,people's values are inclined to be more and more multifarious and the movements for homosexual rights and human rights are also expanding,which is an unprecedented challenge to traditional marriage system.As a newly arising problem in marriage law,homosexuality and its marriage arouse more and more concern from people,and they are even legal in some other countries.Therefore,it's necessary for China to solve such a problem by legislation.Based on the practical situation in China,this paper introduces the process of people's cognition towards homosexuality,aiming to expound the necessity of legislating for homosexuality in China.Some suggestions are put forth to arouse the concern for homosexuality on the field of law.
