略论我国民事诉讼代理制度的改革与完善

民事诉讼代理制度是现代民事诉讼制度中的一项重要制度。我国民事诉讼代理制度坚持的是诉讼"大众化"的思路,基本没有明显的限制。但随着我国法治的发展,民事诉讼代理制度已日益暴露出一系列弊端。这就要求对我国民事诉讼代理制度进行改革和完善:建立民事强制律师代理制度;完善法律援助制度;建立诉讼保险制度;保障诉讼代理人的调查取证权。

The civil action proxy system is important in modern civil action system. Civil action proxy system insists on the ideas of 'the popular lawsuit',not obvious limit basically in our county. As our country's law development,the civil action proxy system has exposed a series of drawbacks day by day. This requests the reform and perfection to our country's civil action proxy system: establish the system of civil compelled attorney agent; perfect the system of legal aid; establish the system of lawsuit issurance; safeguard the rights of investigate and obtain evidence of civil action proxy.
