我国推行平等协商和集体合同制度存在问题及对策研究

Problems and Countermeasures of the Systems of Equality Negotiation and Collective Labor Contract

平等协商和集体合同制度是国际工会运动的产物,在工人集体维权方面发挥着重要作用。文章试从该制度的时代背景、现状、存在问题及对策等方面展开论述。针对我国推行此制度过程中存在的种种问题,笔者认为应当从加强立法、加大宣传力度、利用三方协调机制、提高协商代表能力等方面加以改善。

The systems of equality negotiation and collective labor contract result from the international trade unions movement,which play an important role in workers' collective right protection.This paper introduces the origin,history background,actualities,problems and countermeasures of the systems of equality negotiation and collective labor contract.Such measures as enhancing legislation,strengthening propagandizing extent,using the triple negotiation rules and improving negotiation deputies' ability should be adopted to solve some existing problems when executing the systems of equality negotiation and collective labor contract in China.
