摘要
合同法定解除权成立后,权利人应当通过一定的方式和程序行使这一权利。合同法定解除由权利人以意思表示通知对方的方式行使法定解除权,针对目前在法定解除权行使过程中需要注意的问题,本文分析了其中的不足之处,并提出了改进与此相关的立法建议。
After the legal termination in contract,the obligee should exercise his right through some way and procedure.The way of the legal termination in contract is that the obligee should tell the other his(her) meaning to exercise this right.This paper,aiming at some problems of legal termination in contract,analyzes some of its weak points and puts some improving suggestions of lawmaking.
