“亲亲相隐”制度在我国现行立法中的缺失及其存在的合理性

作为中国法律传统中的一个典型制度和古代刑法的一项基本原则,"亲亲相隐"体现了鲜明的人伦精神,而我国现行立法中的相关规定舍弃了这一制度,这其实违反了人性与人伦道德,与现代法治精神相悖,也不利于保护人权及维护社会的和谐与稳定,其在司法实践中的危害日益显现。"亲亲相隐"有利于社会的和谐,符合刑法谦抑精神的要求,体现了对人性的呵护和关怀,反映了法律制度改革的要求与方向。

'Mutal—concealing among Relatives'reflects the spirit of human ethic.It is a typical Chi- nese traditional system and a basic principle in the ancient criminal law.However,the present laws in our country have deserted this system,which goes against human nature and justice and the spirit of modern law.At the same time,it is bad for the protection of human rights and the harmony and peace of our society,causing more and more harm.'Mural—concealing among Relatives'does good to the har- mony of our society and fit the demand of criminal law's spirit,presents the care for human nature and reflect the demand and direction of law reform.
