On the Perfection of Criminal Suit with Civil Action System

我国刑事附带民事诉讼制度设立的主要目的是加强对被害人权益的保护,但在司法实践中存在若干冲突。因此,必须对“精神损害赔偿”等方面的制度进行修订和完善,使该制度在被害人保护方面的价值真正得以现实。

The main purpose of the establishment of criminal suit with civil action system is to strengthen the protection of the injured party,but in judicial practice,there exist some conflictions.Therefore,we should modify and perfect the 'spiritual compensation for damages',to realize the value of the system in protecting the injured party.
