交通事故中的弱者保护问题

The Protection of the Weak in the Traffic Accident

在交通事故中,行人相对于机动车方和保险公司是弱者,机动车方相对于保险公司是弱者,肇事机动车方相对于交通事故处理部门也是弱者。对交通事故中的弱者进行保护可采取以下法律措施:机动车方对行人承担无过错责任;行人对保险公司享有直接赔偿请求权;承认“三者险”为“强制险”,而不是“商业险”;免去对肇事车辆的扣押等。

In traffic accidents,compared with the vehicles and the insurance companies,passers-by are the weak;compared with the insurance companies,the vehicles are weak;compared with traffic administers,trouble-making vehicles are weak.In order to protect the weak in the traffic accidents,the following measures should be taken: the vehicles respond strict liability for the passers-by;the passers-by have claim right for direct compensation;insist on 'the third party liability insurance of vehicle' is 'forced insurance' rather than 'commercial insurance';avoid distraining trouble-making vehicle and so on.
