面对我国外观设计专利申请泛滥、申请水平低的现状,统一外观设计专利的授予标准已迫在眉睫。根据专利法的立法宗旨和国外外观设计授予范围的发展趋势,授予外观设计专利应强化新颖性判断标准,引入创造性的要求,而不应从“美感”的主观标准来判断。

Currently, the low - level deluging applications for the patent of industrial design have made it an urgent task to standardize the awarding criteria. On the basis of the legislation tenet of Patent Law and the development tendency of the awarding scope for industrial design patent in foreign countries, in granting such patents, we should, instead of judging by the subjective 'aesthetic' standards, consolidate the judgment criteria of originality, introduce requirements for creativity, and design objective evaluation standards for homogeneous or identical patent applications.
