浅议“公共地役权”制度缺位——从架空线建设角度探讨

The Vacancy of Public Servitutes Paraediorum——From the angle of the electric power networks construction

我国现行的物权法的相关制度,包括相邻关系、征收征用制度、地役权制度等不足以支撑架空线建设合法、经济、效率的取得所需要的土地以及地上空间。参考法国的"行政地役权"制度、我国台湾地区的"公用地役权"制度等对于因公共利益而设立的地役权予以单独立法的规定,结合我国理论与实践中对于"公共地役权"制度的运用,应当在探讨"公共地役权"制度与现行的地役权制度的区别,分析公共利益和公共地役权供役地人的权利平衡问题的基础上,在《物权法》中加入公共地役权制度。
