论舆论监督权的行使和制约

Driving and Constraints of the Right of Supervision by Public Opinion

宪法规定公民有监督权,新闻媒体集中代表行使着这一权力,在行使过程中,新闻媒体却偏离了监督的方向,大致有以下三种偏差,一是表现为侵权;二是没有起到监督的作用,反而沦为了被监督机关的"代言人";三是新闻媒体没有实行监督,自身反而滋生了腐败。这些都是对公民监督权的滥用,那么,该如何规范新闻媒体的监督权呢?一是要引导全社会对舆论监督和依法治国的正确认识;二要完善我国舆论监督权的立法,制约和规范舆论监督权;三是要求新闻媒体严格按照新闻规律办事,遵守职业规则,正确实施舆论监督权。
