摘要
对于图书馆"超期罚款"行为的合法性,理论界多有争论。有些学者认为其违反有关行政法律的罚款规定而采取否定态度;也有学者从民法角度对其进行分析,试图赋予其合法性。但是,从行政法理来分析会发现,图书馆的"超期罚款"行为只是一种行政合同履行行为,不存在违法问题,亦无改名之必要。
At present,theorists possess different ideas on the validity about overdue fine system of the library.Many scholars have the negative attitude because it is illegal from the aspect of the related administrative law.Some scholars attempt to prove its validity from the civil law angle.Yet,if we study it from the law angle of administrative legal theory,we will find that the essence of the overdue fine system of the library is one kind of fulfillment behavior about administrative contract.
