Rights Conflict and Its Balance in Ownership Reservation

本文分析在国内外贸易中实行的所有权保留制度。文章首先阐述了"所有权保留"的概念和原理;继而着重对所有权保留中的相关权利进行剖析,尤其是对买受人的期待权和出卖人的取回权进行了较为深入的论证,由此揭示出卖人、买受人及第三人之间的权利冲突,并主张运用物权公示原则去合理平衡各方当事人的利益。

The article analyzes the system of Ownership Reservation, which widely applies to internal and external trade. Beginning with the concept introduction and the principle demonstration of such system, the article deals with the relative rights in Ownership Reservation, especially the system of Anwartschaftsrecht and Ersazaussonderungsrecht. For the conflicts between the seller, buyer and the third party, the article holds that the reasonable adoption of demonstrative principle of real right can balance the interests between the clients.
