摘要
效率违约并非一种独立的违约形态,是对部分违约行为在经济视角下的肯定性价值评价。应借鉴西方经济分析法学派将效益原则引入违约评析之中及相应的违约救济理论,完善我国合同违约责任制度。
Efficiency breach is not an'indeperdent breach behaviour. It is a positive value evaluation of certain breach perceived from the economic point of view. The School of Economic Analysis in the West has introduced efficiency principles into the breach analysis and established a corresponding theory of breach compensation. It would be advisable to take some insights of the school to improve the responsibity system concerning contract breach in China.
