摘要
创设我国让与担保制度已有理论基础 ,市场经济的共同性为借鉴国外法系创设我国让与担保制度提供现实可能。增设“让与担保”法律制度 ,统一房地产按揭制度于让与担保制度中。
The creation of our security transfers system has theoretical foundation. The common features of market economy has provided possibilities for borrowing overseas law system. The creation of security transfers system and unifying real estate mortgage are in the system of security transfers.
