论我国缓刑制度存在的缺陷及其完善

Discussion on the Flaws and Improvement of Probation System in China

缓刑制度的适用在我国司法实践中起到了重要的作用,产生了良好的社会效果。但是,在具体操作中存在着缓刑适用的规定过于抽象、缓刑考察制度不健全等问题,妨碍了适用缓刑目的的全面实现。因此,应对缓刑适用的条件进一步细化,确立对未成年犯适用缓刑的特殊规定,健全缓刑制度的各项内容。

Probation is one of the important penal systems,which plays an important role in our current judicial practice.However,probation system still has many specific problems,such as the conditions to the current system of general probation being too principle that hinder the realization of the real purpose of the application of probation.Since it has such problems,it really needs reform and improvement.Therefore,the conditions applied to probation system should be further refined,the special provisions to juvenile offenders probation should be established,the contents of the probation system should be improved.
