Patenting business methods has become an international trend and finance industry, especially bank industry, becomes the one who develops the quirkiest on business methods patent. Therefore, studying business method patent of finance industry has important strategic meaning. The paper briefly presents the theory of business method patent and its application in finance industry. Then it analyzes current situation of business method patent home and abroad and the effects of inferior position of domestic business method patent on national finance industry. Finally, the article brings forward countermeasures of our country's legislation institution and finance institution.
