十六届三中全会提出的科学发展观为政府职能转变和政府在经济法中的准确定位提供了新视角、新要求。经济法作为规范政府经济职能之法,它与科学发展观具有内在的一致性。在经济法中实现政府的准确定位必须以科学发展观为指导。按照科学发展观的要求,寻求政府在经济法中的准确定位,必须贯彻法定原则、比例原则、绩效原则,实现控权与保权的有机结合。

Scientific concept of development provides a new perspective and requirement for the transformation of government functions and the exact positioning of the government authority in economic law.A fundamental law to normalize the government economic authority,economic law is internally consistent with the scientific concept of development.To achieve the exact postionting of the government authority through economic law,it is essential to uphold scientific concept of development as our guide.According to the requirement of scientific concept of development,the exact positioning of government authority in economic law should follow the principles of constitution,proportion,and performance so as to combine organically the preservation and the control of the government authority.
