On The Transitional Product-specific Safeguards Mechanism of Section 16 of the Protocol in the Accession of the People's Republic of China to the WTO

中国的入世标志着中国经济与世界经济的全面融合,从而中国经济各行业面临着前所未有的机遇与挑战。而《中国入世议定书》第16条中规定的特殊产品过渡性保障机制尤其值得我们关注。根据特保措施,任何WTO成员都有权对大批涌入的中国产品施行特保措施,其条件却比《WTO保障措施协定》下的更宽松。因此,中国应着重于对特保机制与WTO保障机制区别研究,寻求如何有效利用特别保障机制,积极应对来自其他WTO成员的指控。

China's accession to WTO signifies its comprehensive participation in the world economy.All aspects of our domestic economy are confronted with more opportunities and unprecedented challenges.The transitional product-specific safeguard mechanism of Section 16 of the Protocol on China's Accession to the WTO lies in the heart of the problems.Under the special safeguard mechanism,WTO Member countries can apply safeguard measures in response to surges in imports from China on less restrictive conditions than those under the current WTO Agreement on Safeguards.Therefore,China should familiarize itself with and exploit effectively the Transitional Product-specific Safeguards Mechanism,and consequently minimize their unfavorable impacts on China's economy.
