审判委员会制度改革的建议

The Reform Advice of the System of the Judicial Committee

审判委员会是人民法院内部对审判工作实行领导的组织形式。审判委员会的职能是讨论重大、疑难、复杂案件的法律适用问题 ,总结审判经验 ,对审判工作带有根本性问题、全局性问题进行研究和作出权威性指导。现行的审判委员会制度存在着严重的弊端 。

The Judicial Committee is and organization in the People’s court that supervises the work of judgment.The functions of this Committee are to discuss the application of laws to major,disputed and complicated cases,sum up judging experience and give an authoritative direction and make a study of the fundamental and universal questions ocurring in the work of judgment.However,there exist some serious drawbacks in the current system of the juicial committee so that it has brought about a lot of problems in practical operation.This essay proposes some measures to be taken to reform the current system of the Judicial Committee.
