摘要
本文通过对法制史上旧中国民法的制定历程的回顾和体系的分析,找寻当今中国民法典的合理体系,以及借鉴德国民法典体系的理由。
The article tries to find out the reason why China's civil code has borrowed some from German civil cede through analyzing and dating back the process and system of instituting traditional Chinese civil codes in the history of old China.
