摘要
情事变更原则是现代民法中一项重要制度,纵观其发展,可见其追求的是合同的实质理性,而非形式公平,这项原则应当在我国《合同法》中加以具体规定。
The change of situations constitutes one of the essential institutions in civil law.Viewing its development one can see that it is pursuing the substantial rationality of the contract law rather than some formal justice and such a in- stitution shall be written into the contract law.
