我国民间资本参与铁路建设的法律障碍 被引量:6

摘要 一些经济发达国家和地区的经验表明 ,民间资本以BOT方式参与基础设施建设能够较好地解决公共物品与私人物品之间的矛盾。随着民间资本实力的壮大 ,我国已有大量民间资本以BOT方式参与基础设施建设 ,但少有民间资本参与铁路建设。为解决铁路建设资金不足并为民间资本提供新的投资机会 ,我国应加快铁路投资体制改革 ,修改铁路法、担保法、公司法、税法等相关法律 ,制定详细优惠政策 ,扫除民间资本参与铁路建设的诸多法律障碍 。 Some experiences in developed countries and regions indicate that the contradiction between public goods and private goods can be handled preferably when non_governmental capital is invested in infrastructure with the method of BOT. With the increasing accumulation of non_governmental capital in China, it has been invested in infrastructure except railway construction in BOT mode. To solve the problem of capital scarcity and offer another investment opportunity for non_governmental capital, our government should speed up the structural reform of railway investment, amend the railway law, guarantee law, corporation laws, taxation laws and other related laws, make particular privilege policies and clean off the legal impediments in railway construction for non_governmental capital in China.
