合同法与我国外贸代理法律制度改革

The Analysis of the Chinese System of Agency in Foreign Trade in Contract Law

推行外贸代理制是我国外贸体制改革的重要内容。然而在新《合同法》颁布前 ,我国外贸代理立法混乱 ,阻碍了外贸代理制的推行。文章针对目前存在于我国外贸代理制中的缺陷 ,分析《合同法》对其新规制和完善 ,以期改革和完善我国现行的外贸代理法律制度 。

Its an important content of Chinas structural reform of foreign trade to carry out the system of agency in foreign trade. However, before the promulgation of China's contract law,the legislative confusion of the system of agency in foreign trade impeded the practise of it. According to the defects in Chinas system of agency in foreign trade, the article analyses the new stipulation and perfection of it in order to reform and perfect it nowadays, as well as to build a legislative system of agency in foreign trade which is efficiently adjusted to WTO regulations.
