试论重大环境污染事故罪认定中的三个问题

A Tentative Discussion of the Three Issues in Affirming the Environmental Pollution Crime

本文通过对西方国家污染环境犯罪的立法研究并结合我国的实际情况,着重深入分析论证了重大环境污染罪中是否应设立危险犯、是否应引进严格责任制度以及环境污染犯罪中的因果关系的认定这三个重要的问题,希冀通过对重大环境污染事故罪的科学认定进一步完善我国刑事处罚机制,从而有助于我国的环境污染治理。

The paper demonstrates three issues of environmental pollution crimes: the possibility of setting up dangerous crime,introducing into system of strict liability,cognizing the theory of causality.Perhaps, considering these issues helps forward improving mechanism of criminal punishment and benefits to governing environmental pollution.
