摘要
本文从量刑答辩立法上的规定与司法实际中的现状出发,讨论了量刑答辩与诉辩交易的异同,提出了看法。此外,又对量刑答辩的价值扩张所需要的刑事诉讼制度的完善进行了讨论。
Starting from legislative regulation of the crime measurement pleading and the practical status of judicatory,the article discusses the difference and the common ground between the crime measurement pleading and pleading negotiation,and points out some opinions. Furthermore,it discusses the improvement of criminal suit system that the value expansion of the crime measurement pleading needs.
