从行使行政职权和发生行政法律效果的行为主体看 ,行政合同行为是具体行政行为 ,具有单方面性 ;从合同条款的成立和效力看 ,行政合同行为又具有双方合意性。行政合同具有行政性和合同性双重特性 。

In the light of the subject exercising administrative authority and the legal effect of administrative law, an administrative contract is a unilateral and particular administrative act. From the conclusion and the force of the clauses binding on the two parties, it is a bilateral act. An administrative contract is both an administrative act and a contract.
