Limitation and Anti-Limitation of Copyright in Library

利益平衡是版权制度的核心内容 ,同时这也是图书馆受到版权法保护的理论和实践基础 ,因为图书馆具有协调版权人与读者之间利益关系的均衡器的功能。图书馆在版权制度中的特殊效用是通过版权的限制与反限制得到充分体现的 ,在解决数字图书馆的版权问题中 ,版权的限制和反限制仍然是必须坚持的最基本原则 ,关键问题是把二者维持在合理的利益平衡点上 ,使版权人、图书馆、读者的利益共存与相容。

Interest balance is the core of copyright system,also it is the theoretical and practical basis of which libraries has been protected by copyright law,for libraries have the function to coordinate the interests of copyright owners and readers.The special effectiveness of libraries is fully realized by means of limitation and anti-limitation,as to solve copyright systems of digital libraries,it is still the basic principles we must insist on.The key to the question is to coordinate the two sides,make copyright owners,libraries and readers existed peacefully.
