随着民主和权利意识的增强,高校与学生发生矛盾时被诉上法庭之事在各地频繁发生。然而,该领域行政法理论和实务的不统一使大学生维权屡遭瓶颈。因此,努力完善司法救济的同时建立一套更加公正民主的事前预防机制,即听裁审议制度,力求将学生与学校的纠纷化解于未然之中成为当务之急。

Universities are frequently sued for the contradictory between themsleves and their students with spreading of democratic and rightful consciousness.But,outcomes usually let students embarrassing because of inconsistency in Administrative law theories and practice.Building a kind of more suitable and democratic prevention system,that is listening and judgment system,has a predominant value in avoiding contradictory between student and university while judicial assistance are gradually consummated.
