摘要
单位犯罪是新刑法中规定的新罪名 ,其危害性、破坏性是不言而喻的。从单位犯罪的概念入手 ,论述了单位犯罪在司法实践中出现的问题 :单位犯罪的主体范围之界定 ,单位犯罪主体的罪过形式以及处罚原则等 。
This paper begins with the concept of unit Criminal Offence. Then it demonstrates the problems concerning Unit Criminal Offence in the judicial practice, such as how to determine the subject of the Unit Criminal Offence, the criminal forms and punishment principles of the subject of Unit Criminal Offence. Finally, it puts forward the corresponding measures to solve these problems.
