对规范合议庭与审判委员会活动几个问题的探讨

Some Issues Concerning the Regulation of the Activities of Collegiate Panel and the Jury

从人民法院合议庭与审判委员会两个审判组织的工作现状出发 ,围绕合议庭成员的业务水平问题、合议庭成员间、合议庭与庭长间、合议庭与审判委员会间存在的问题以及审判委员会组成结构不科学而在实践中造成了“审”与“判”的分离等问题 ,提出了进一步规范合议庭与审判委员会活动的意见和建议。

The disagreement of trial with sentencing can be ascribed to the differences between the professional expertises of those in the collegiate panel and those in the jury and among the members of each of those two organizations. Thus a scientific structure of each organization is necessary if their activities are to be properly regulated.
